If I work 5.5 hours a day , I work 2.45 hrs then go on a 30 min break then come back and work another 2.45 hrs. Am I entitled to paid 10 min paid break?

Thank you for your question. Yes, if your shift is 5.5 hours long and you are non-exempt, you are entitled to one paid 10-minute rest period in addition to your one unpaid 30-minute meal break. (See Brinker Restaurant Corp. v. Superior Court (2012) 53 Cal.4th 1004, 1029 [”Employees are entitled to 10 minutes’ rest for shifts from three and one-half to six hours in length. . . .”]; Cal. Code of Regs., tit. 8, §§ 11010–11150, subd. 12(A).)
